The Road Accident Fund (RAF) is a statutory body by which the South African Government provides compensation for loss or damages suffered due to bodily injury or death as a result of a motor vehicle accident. The RAF is funded by a levy gathered on all fuel consumed by South African drivers.

Who Can Claim Against the Road Accident Fund?

In order to successfully claim from the road accident fund, the following must be established:

  • Damages suffered were caused by the driving of a motor vehicle 
  • Such a motor vehicle was driven in a negligent manner
  • Bodily injury or death resulted from a motor vehicle collision 

People who may claim from the Road Accident Fund include but are not limited to:

  • Passengers in a motor vehicle that was driven in a negligent manner 
  • Passengers or drivers in a motor vehicle that is struck by another vehicle that was driven negligently 
  • Pedestrian knocked down by a negligent motorist 
  • Children, spouses, or other dependents of a person killed in a motor vehicle accident
  • People responsible for an accident but are not the owner of a vehicle and the accident was a result of the owner neglecting to repair or maintain the vehicle driven
