As we head into the last few days of 2021, I would like to convey our gratitude to everyone that has made 2021 one of our firm’s best years to date! Despite all the challenges that our clients, colleagues, friends and family have had to overcome, we are exceptionally grateful that we have been able to make new friends and build on existing relationships, 2022 is indeed looking promising. With the news that South Africa has been removed from the United Kingdom’s travel “red list” as of today, I hope that many of you are now able to make last minute plans to spend the festive season with loved ones. The same goes for those that will be travelling locally. Please travel safely to and from your holiday destinations if you have plans to do so, and we look forward to catching up again in 2022. After a long and tough year, the Covid 4th Wave called Omicron, has hit the Western Cape. Fortunately, this has not as severely impacted the conveyancing industry here, yet. Currently our registrations are taking the normal 7-10 days to register and this is good even when measured against other Decembers. To give credit where it is due, the Cape Town Deeds Office decontamination procedures have been proven very quick and efficient and not causing multiple day closures. City of Cape Town has returned to their normal turnaround times for Rates Clearance Certificates and, in our experience, so has SARS. So, all in all, things are looking up. Onwards to 2022!
We are approaching the end of the year facing important developments in South Africa. With the discovery of the new Covid-19 variant Omicron, the national conversation has shifted to whether it is time for South Africa to consider involuntary vaccination. The loudest voice in support of this has been from the business sector, whose interests remain at stake the most as long as the economy trades on the backfoot. Under the auspices of the National Economic Development and Labour Council (NEDLAC), which is a coalesce where business, labour and government converge to inform and influence policy, it was agreed to seek the wisdom of the Constitutional Court on the matter, and possibly request a declaratory order on vaccine mandates particularly for employees. We have seen how MTN and Standard Bank recently announced their vaccine policies to employees. The South African Federation of Trade Unions (SAFTU), on the other hand, has also indicated that they have plans to approach the highest Court for guidance. From a litigation perspective, this is welcome news as the benefits are immense. In our law, there is no precedent on compulsory treatment, which includes vaccination. However, medical testing is provided for under Section 7 of the Employment Equity Act, 55 of 1998. The cases of Minister of Safety and Security And Another v Gaqa (2002) ZAWCHC 9 and Minister of Health Western Cape v Goliath And Others 2009 (2) SA 248 (C) the right as provided in Section 12 (2) of the Constitution of the Republic of South Africa was limited, although it did not relate to vaccination. Consequently, this presents a long overdue opportunity for our Constitutional Court to fill that gap in our law.
